NIS 2 Directive comes into force in October 2024 – What companies need to know now
The NIS 2 (Network and Information Security) Directive will come into force on October 17, 2024 and will extend the obligations and regulatory oversight for companies in 18 critical sectors, including energy, transport and healthcare. The aim is to achieve a higher level of cybersecurity in the EU. Affected companies must comply with comprehensive security measures and reporting obligations to avoid high fines.
Cybersecurity measures (Article 21)
Companies must implement specific cybersecurity measures, including:
- Risk management processes
- Technical and organizational security measures
- Regular safety assessments and tests
Responsibility of management (Art 20)
Management is responsible for compliance with the NIS2 Directive and must ensure that appropriate cybersecurity strategies are implemented.
Obligation to report security incidents (Article 23)
The obligation to report security incidents involves a three-stage system:
- Early warning within 24h after discovering an incident.
- Interim report within 72h with detailed information.
- Final report within 30 days after the incident has been resolved.
